Failure to file federal income tax returns can potentially be a crime, punishable with jail time. Failing to pay any tax or estimated tax can be considered a misdemeanor. A conviction may result in fines, jail time or both. If you are convicted, you may also have to pay costs incurred by the prosecution during the case.
